Estate planning and wills- Estate planning involves planning for the transfer of property of a deceased person upon death by use of a valid will or a trust. Guardianship and elder law- Guardianship is the legal process for management of the property and personal needs of an incapacitated person. An incapacitated person is a person who cannot manage his/her own financial or personal affairs. Real estate transactions- For probate or guardianship, real estate frequently need to be transferred. Power or Attorney- A Power of Attorney may be useful to avoid a guardianship, which is subject to court supervision, and manage the affairs of an incapacitated person privately by a relative or friend chosen by an incapacitated person before he/she becomes incapacitated. Litigation- Some probate or guardianship matters require a trial or various hearings to decide disputed matters. Generally, the firm uses hourly rates for cases, but Donald E. Elliott handles a select number of contingency fee cases for will contests, probate litigation, and trust disputes. We also understand that for some families, alternative dispute resolution techniques, including arbitration, mediation, or collaborative representation, may be preferable to litigation.
